Because he also had the qualifications to be Kage. However, because he showed up late I struck him a deal. If he could beat me in a 2/3 match, I would give him the seat of kage and become the first legendary sannin. He lost, so he geot to become the first legendary sannin. That's all there is to it.

ok but kabuto technqily he is in charge of all de legendry sannin so 3 people can join and i know dis i will be a sannin i will not be orochimaru and tsunade i will be
